10 Key Compliance Takeaways from the PA Home Care & Hospice Conference


1.        New quality measure for Electronic Visit Verification (EVV) includes having no more than 15% manual edits starting January 1, 2025.*


2.        New Nursing Home Staffing Standards take effect from August 10, 2024.


3.        New Ensuring Access to Medicaid Services final Rule and the 80/20 Rule: Requires agencies that provide home and community-based services to spend at least 80% of their Medicaid payments for homemaker, home health aide, and personal care services on direct care worker compensation.  Rule will be effective from 2030.


4.        New Section 504 Final Rule to strengthen protections for disabled people has been published.


5.        New Adult Protective Services Final Rule effective from June 7, 2024. Providers have until June 7, 2028 to fully comply. 


6.        CMS’ approval for texting patient orders is limited to hospitals and critical access hospitals; the approval does not currently apply to other provider services.


7.        Violations of Wages and Fair Labor Standards laws pose significant compliance risks. Compliance is complicated, in part, by staffing shortages and challenges in staff retention.


8.        Non-compete clauses must be used with care; they may not be used to unfairly prevent staff from pursuing other employment opportunities and must not restrict patient choice.


9.        National quality standards for Private Duty Nursing are in development.



10.   CMS is terminating the Hospice Value-Based Insurance Design (VBID) from the Medicare Advantage Program at the end of this year
